Civil Cases

JP v. Allstate Insurance – Personal injury automobile accident case - $55,000 - Plaintiff was the passenger of a car that was struck by a negligent driver. Soft tissue injuries and damage to Plaintiff's upper lip. Lawsuit was filed but the case settled prior to trial.
Thomas v. Local Hospital and Doctor – Fulton Co. Superior Court Case No. 2006CV123335 – Medical negligence case - doctors and/or nurses left a surgical sponge inside of Plaintiff’s abdomen. Case settled for six figure sum and the settlement included forgiveness of medical bills over $100,000.  Derric Crowther of the Crowther Law Firm was instrumental in resolving the case.
 
B.W. v. Unnamed Gas Station and Negligent Driver – married woman walked out of a convenience store of a gas station and she was struck by a small minivan and pinned to the outer brick wall of the building. The driver of the minivan pressed the gas pedal instead of the brake pedal and the vehicle jumped the curb and hit Plaintiff. She suffered broken toes, damage to her right knee and other injuries. Obtained full auto policy limits of the negligent driver. Obtained a large settlement against the gas station for failure to erect barriers in front of the building to protect patrons.
 
Estate of I.L.S v. Progressive Insurance Co. – wrongful death automobile accident – woman killed when a log truck negligently crossed the center line and crashed into her vehicle. Six figure settlement against the defendant driver. Double Digit settlement against the tree company. Kevin A. Adamson of Kevin A. Adamson P.C. assisted in obtaining the settlement against the tree company.
 
Estate of T.G. v. Liberty Mutual Insurance Co. – wrongful death automobile accident – passenger killed when the negligent driver swerved of road and hit a tree. Six figure settlement against the defendant driver. Double Digit settlement against Plaintiff’s insurance company. Kevin A. Adamson of Kevin A. Adamson P.C. was instrumental in obtaining the settlement against the insurance company.
 
Dixon v. Auto Owner’s Insurance - $48,000.00 – personal injury auto accident – Plaintiff suffered a fractured collar bone after being hit by a Defendant who ran a red light and stuck his car.
 
Yeas v. MARTA – personal injury automobile v. pedestrian accident - $25,000.00 – Plaintiff struck by a MARTA bus as he was in the crosswalk (Soft Tissue only).
 
Wright v. Allstate Insurance - personal injury automobile v. pedestrian accident - $32,500.00 – Plaintiff struck by a negligent driver as he was assisting a motorist who has driven into a ditch (Soft Tissue only).
 
Johnson v. Auto Owner’s Insurance - $18,000.00 - personal injury auto accident – Plaintiff suffered soft tissue injuries after being hit by a negligent Defendant.
 
Beasley-Teague v. Progessive – $24,500.00 - personal injury auto accident – Plaintiff suffered soft tissue injuries after being hit by a negligent Defendant. Kevin A. Adamson of Kevin A. Adamson P.C. was instrumental in obtaining the settlement against the insurance company.
 
Bowen v. State National Insurance - $24,000.00 - personal injury auto accident – Plaintiff suffered soft tissue injuries after being hit by a Tractor Trailer.
 
Jackson v. Corbett – Bibb County State Court Case No.: 60354. JV No.:490184 - $13,500.00 - personal injury auto accident – Plaintiffs suffered soft tissue injuries after being hit head-on by a negligent Defendant. Derric Crowther of the Crowther Law Firm came aboard for trial and he was instrumental in resolving the case at trial.
 
Wyatt v. City of Atlanta – $10,000.00 – slip and fall case. Plaintiff stepped into an uncovered water meter and sprained her ankle.
 
Scarlett v. Liberty Mutual - $20,000.00 - personal injury auto accident – Plaintiff suffered soft tissue injuries and a scar to her shoulder after being hit by an uninsured and unidentified driver of a stolen vehicle. In this case we obtained relief from the Plaintiff’s uninsured motorist policy. Kevin A. Adamson of Kevin A. Adamson P.C. was brought into the case to represent the two passengers inside of Scarlett’s vehicle and he obtained an additional $30,000.00.
 
Jenkins v. Red Lobster - $25,000.00 - slip and fall case. Plaintiff slipped and fell onto the tiled floor of a restaurant which had been made slick due to grease from the kitchen.
 
Williams v. Allstate Insurance - $25,000 - Plaintiff suffered injuries after being rear-ended by a drunk driver.
 
Kincey v. TCS One - $12,500.00 - personal injury auto accident – Plaintiff suffered soft tissue injuries after being rear-ended by a Tractor Trailer. Plaintiff had $400.00 in damage to his rear bumper.
 
Gill v. Progressive Insurance - $13,500 - personal injury auto accident – Plaintiff suffered soft tissue injuries after being rear-ended by a negligent driver.

State v. Saiji Johns - Y14005, Murder, Felony Murder, Aggravated Assault (8), Possession of a Firearm During the Commission of a Felony. Client and co-defendants accused of shooting up an apartment complex with AK-47 Assault Rifles during a drug turf battle. Not Guilty on all counts. Judge Bensonetta T. Lane, Fulton Superior Court.
 
State v. Derek Bush - Z63919, Murder, Felony Murder, Aggravated Assault, Possession of a Firearm by a Convicted Felon, Possession of a Firearm During the Commission of a Felony. Client accused of murdering the victim at an apartment complex. Not Guilty on all counts.
 

State v. Mark Geter - 01SC11017, Murder Felony Murder (3), Aggravated Assault, Cruelty to Children, Cruelty to Children. Defendant accused of beating and burning 14 month old Crystal Langley. Victim’s mother pled guilty and testified against the defendant in exchange for a 15 year prison sentence. Mother testified that Defendant had battered her and had tied her to a tree and threatened to have his pit bulls (Mickey and Mallory) bite her. She also testified that Defendant had poured gasoline on her and threatened to set her afire. Defendant had always maintained that the mother had actually beaten the child when he was at work or away from the home. Not Guilty of Murder and Cruelty by Burning. Hung on the remaining counts. Judge Stephanie B. Manis, Fulton Superior Court. Case was finally resolved prior to retrial.

Judge Manis held Attorney Butterfield in contempt of court because he conducted a very vigorous and thorough cross-examination of the child’s mother who was the co-defendant/star witness. The Court of Appeals of Georgia REVERSED AND REMANDED the case. “Thus, no evidence supports the court’s finding that Butterfield willfully disobeyed the court’s order to complete his cross-examination with the time specified…We hold that an order to reorganize one’s cross-examination is simply too vague to be the basis for a contempt order.” In re Butterfield, 265 Ga. App. 745, 595 S.E. 2d 588 (2004).

 
State v. Steve Stephens - 00SC12355, Murder, Felony Murder, Aggravated Assault. Defendant accused of shooting the victim at the Shell gas station in Atlanta, Georgia after a heated argument. Defendant argued that he was defending himself when he shot and killed the victim. Not Guilty on Murder, hung on Felony Murder, Aggravated Assault, which were later placed on the Dead Docket. Judge Stephanie B. Manis, Fulton Superior Court.
 
State v. Victor Davis - 03SC03874, Murder, Felony Murder, Aggravated Assault (2), Kidnapping, False Imprisonment, Possession of a Firearm During the Commission of a Felony. Defendant was accused of robbing and killing the victim after the victim had provided Defendant with food and shelter. Defendant testified that the victim was a homosexual drug dealer who tried to force Defendant to engage in homosexual sex acts at gunpoint. Not Guilty on Murder, Kidnapping. Hung on remaining 6 charges. Judge Stephanie B. Manis, Fulton Superior Court.
 
State v. Willie Williams - 04SC14611, Murder, Felony Murder, Aggravated Assault, Possession of a Firearm by a Convicted Felon. Defendant had an argument with a female named Yo-Baby, who got upset with Defendant and called her boyfriend to come and harm Defendant. Defendant shot and killed the deceased in self-defense. Attorney Butterfield investigated the case thoroughly and discovered that the deceased actually exited his vehicle with a handgun, approached Defendant and threatened to shot Defendant. Persons on the scene removed the gun from the deceased’s hand before the police arrived. Attorney Butterfield was able to convince the eyewitnesses to come forward and admit the dead man was armed and dangerous at the time of the shooting. Not Guilty on all murder/assault counts. Guilty PFCF. Judge Campbell.
 
State v. Henrietta Russell - 04SC1550, Murder, Felony Murder, Aggravated Assault. Defendant was a crack addicted prostitute who was accused of murdering a homeless man inside of a broken down van that he used as his home. Defendant testified that the deceased invited her into the van to use drugs. Once she was inside of the van, the Defendant testified that the deceased attempted to rape her and she was able to grab a weapon and stab him several times. Not Guilty on all Counts. Bench trial before Judge Alford J. Dempsey Jr.
 
State v. Christopher Kennedy - 02SC02543, Murder, Felony Murder, etc. Defendant accused of killing a man who had robbed him several months earlier. This was a retrial after the first jury was deadlocked and unable to render a unanimous verdict. Not Guilty /Hung Jury and mistrial was declared in the second trial. The case was resolved on terms acceptable to Defendant prior to the start of a third trial. Judge Jerry Baxter.
